Acceptance of the Terms of Use

These Terms of Use are an agreement between you and Vanilla Tyme ("we", "us"). They govern your access to and use of the Vanilla Tyme website and its API, including all content and features offered on or through them (the "Website"), whether you are a guest or a registered user.

Please read these Terms carefully before you use the Website. By using it, you accept these Terms, our Privacy Policy and our Content Rules. If you do not agree, do not use the Website.

Anyone may browse the Website, but you must be at least 16 years old to have a website account. By creating an account, you confirm that you meet this requirement.

Changes to the Terms of Use

We may update these Terms from time to time. Changes take effect as soon as we post them, and the date at the top of this page shows when they were last changed. By continuing to use the Website after a change, you accept the updated Terms.

Accessing the Website and Account Security

Website accounts are created from the Vanilla Tyme Minecraft server with the /register command and are linked to your Minecraft account. The information you give us must be correct and kept up to date, and it is handled as described in our Privacy Policy.

You may only have one account, and you must not share it or let anyone else use it. Keep your password confidential, and tell us right away if you think someone else has access to your account. You are responsible for everything that happens on your account. Take extra care when signing in on a public or shared computer.

Your rank on the Website follows your rank on the server and may change. We may restrict access to parts of the Website, or disable any account, at any time and in our sole discretion, including if we believe you have broken these Terms.

About the Website

The Website lets players publish their in-game shops, keep a profile, see the vote leaderboard and support the server through the store. Content you publish is covered in User Contributions below.

API Usage

The Website offers an application programming interface (the "API") that lets you read information from the Website and, with your own account, manage your own content from your own websites or applications. We grant you a limited, non-exclusive, non-transferable and revocable license to use the API, as long as you:

  • use it in line with these Terms, the Content Rules and all applicable laws;
  • do not infringe anyone else's rights;
  • respect any rate limits and do not put an unreasonable load on the Website, including by mass-scraping it;
  • do not suggest that your website or application is made or endorsed by Vanilla Tyme unless we have agreed to it.

The API is provided "as is". We may change, limit or stop it, or revoke your access to it, at any time. You are responsible for any claims that arise from how you use the API.

Store Purchases

Purchases in our store are processed by Tebex, which acts as the seller and handles payment. Tebex's terms of sale and refund policy apply to every purchase, and refund requests are handled under that policy. We never receive your payment card details.

Store perks are used in game and may change over time. If a payment is reversed or found to be fraudulent, we may remove the perks it paid for.

Intellectual Property Rights

Apart from content published by players, the Website and its contents, features and design are owned by Vanilla Tyme or its licensors. The Website's software is built on the open-source Modrinth codebase, which is available under its own license.

These Terms let you use the Website for your own personal, non-commercial use. No other rights are given to you, and any use of the Website that these Terms don't allow is a breach of them.

Trademarks

The Vanilla Tyme name and logo belong to Vanilla Tyme. You must not use them in a way that suggests we endorse or are connected to you without our permission. Minecraft is a trademark of Mojang Synergies AB. Vanilla Tyme is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. All other names and logos belong to their owners.

Prohibited Uses

You may only use the Website lawfully and in line with these Terms. You agree not to:

  • use the Website in any way that breaks any applicable law or regulation;
  • exploit, harm or try to harm minors in any way;
  • post, upload or share anything that does not follow the Content Rules;
  • send advertising, promotional material, spam or any other unwanted messages;
  • impersonate Vanilla Tyme, our staff, another player or anyone else;
  • do anything that limits or prevents anyone else's use or enjoyment of the Website;
  • use the Website in a way that could disable, overload, damage or impair it, or interfere with anyone else's use of it;
  • use any bot, scraper or other automated means to access or copy the Website, except through the API as described above;
  • use any content or data from the Website to train, develop or improve artificial intelligence or machine learning models;
  • introduce viruses, malware or anything else that is malicious or harmful;
  • try to gain unauthorized access to, interfere with or disrupt any part of the Website, the servers it runs on, or any connected system or database;
  • attack the Website with a denial-of-service attack or similar;
  • otherwise try to interfere with the proper working of the Website.

User Contributions

The Website lets you publish content, such as shops, descriptions, images, inventory listings and your profile ("User Contributions"). All User Contributions must follow the Content Rules.

You keep ownership of your User Contributions. By publishing them, you give us the right to host, store, display, reproduce, adapt for display and share them on and through the Website and the API, including after a season ends.

You confirm that:

  • you own or have the rights to your User Contributions and can give us the rights above;
  • your User Contributions follow these Terms and the Content Rules.

You are responsible for your User Contributions, including their legality, accuracy and appropriateness. We are not responsible to anyone for the content or accuracy of User Contributions posted by you or any other player.

Monitoring and Enforcement; Termination

We have the right to:

  • remove, hide, delist or refuse to publish any User Contribution for any or no reason;
  • take any action we find necessary about a User Contribution that we believe breaks these Terms or the Content Rules, infringes anyone's rights, threatens anyone's safety or could create liability for us;
  • report illegal or unauthorized use of the Website to the authorities and take any other legal action;
  • suspend or end your access to all or part of the Website for any or no reason, including any breach of these Terms.

We may cooperate with law enforcement or court orders that require us to disclose information about anyone who posts on the Website. We cannot promise to remove unwanted content right after it is posted, and we are not liable for any action or inaction regarding content provided by players or third parties.

Copyright Infringement

If you believe that a User Contribution infringes your copyright, open a ticket in our Discord with a link to the content and proof that you own the work. We will close the accounts of players who repeatedly infringe copyright.

Reliance on Information Posted

Information on the Website is provided for general information only. Shops, prices, stock and coordinates are published by players, and we do not guarantee that they are accurate, complete or up to date.

The prices and items set up and displayed in a shop in game are what count. Always check them in game before you trade, and do not rely only on what a shop's page on the Website says.

If a trade goes wrong, open a ticket in our Discord. Staff may require that the correct price is paid, or that the trade is reversed and both the items and the payment are returned. Staff decide how each case is settled.

Content provided by players or third parties reflects only their views and is their responsibility, not ours.

Changes to the Website

We may update, change, pause or stop any part of the Website at any time, with or without notice. Content on the Website may be out of date, and we are not required to update it. We are not liable if any part of the Website is unavailable.

Linking to the Website

You may link to the Website, as long as you do so fairly and legally and don't harm our reputation or suggest that we are associated with or endorse you when we are not. You must not display the Website or parts of it inside another site, for example by framing it. We may withdraw permission to link at any time.

Links from the Website

The Website contains links to sites and services run by others, such as Tebex, Discord and links added by players. These links are provided only for convenience. We have no control over those sites, are not responsible for them, and accept no liability for any loss or damage that comes from using them. Using them is at your own risk and subject to their own terms.

Disclaimer of Warranties

The Website is provided "as is" and "as available", without any warranties of any kind, whether express or implied. We do not guarantee that the Website will be secure, error-free, uninterrupted, or free of viruses or other harmful components, or that it will meet your needs.

Limitation on Liability

To the fullest extent allowed by law, Vanilla Tyme and its staff are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from or related to your use of, or inability to use, the Website, any linked sites or any content on them.

Indemnification

You agree to defend and hold harmless Vanilla Tyme and its staff from any claims, damages, losses or costs that arise from your breach of these Terms, your User Contributions, or your use of the Website or the API.

Waiver and Severability

If we don't enforce part of these Terms, that does not mean we give up the right to enforce it later. If any part of these Terms is found to be invalid or unenforceable, that part will be limited as little as possible and the rest of the Terms will remain in effect.

Entire Agreement

These Terms, the Privacy Policy and the Content Rules are the entire agreement between you and Vanilla Tyme about the Website, and replace any earlier agreements about it.
